By browsing the public site, submitting an inquiry, or signing into the client portal, you agree to these terms. If you don’t agree, please don’t use the site.
What we offer
Midsummer Productions is a wedding videography and photography company. Through this site we offer:
- A public marketing site, including our portfolio and packages.
- An inquiry form to start a conversation about your wedding.
- A client portal for booked couples: timelines, contracts, messages, payments, and finished deliverables (films and photo galleries).
Inquiry vs. booking
Submitting an inquiry isn’t a contract. It’s a way to start a conversation. We’ll reply with a quote and a proposed scope. A wedding becomes a booking only when both parties sign a written contract and the retainer is paid. Until then, nothing is reserved.
Payments
All payments are handled through the contract and invoice schedule we agree on at booking. Card and bank payments are processed by Stripe and we never store full payment-method details ourselves. Specific payment terms (retainer amount, installment schedule, refund and cancellation rules) live in your signed contract, not in these site terms.
Your account & the client portal
If we book your wedding, we’ll create an account for you in our client portal. You’re responsible for keeping your password private and for the activity on your account. Let us know right away at hello@midsummerproductions.net if you suspect your account has been accessed by someone you didn’t invite.
What you can post / upload
You may upload files to your client portal: photos, planning documents, vendor contacts, music preferences, anything that helps us film your wedding well. By uploading, you confirm you have the right to do so, and you grant us the limited right to use those files for the sole purpose of planning and producing your wedding.
Don’t upload anything illegal, anything that infringes someone else’s rights, or anything sensitive that has no connection to your wedding. We reserve the right to remove content that violates these terms and to suspend access for repeat violations.
Our work, your license
When we film and photograph your wedding:
- We own the raw footage, the masters, and the finished films and edits we produce.
- You get a perpetual personal-use license to the finished deliverables specified in your contract: to watch, share with family and friends, post on social media, and keep forever.
- We may usea selection of films and photos from your wedding in our portfolio, marketing, and social media. If you’d rather we didn’t, you can opt out at booking or at any time afterward by emailing us. Already-published portfolio entries take a reasonable time to remove (typically 30 days).
- Commercial use of our deliverables (in ads, paid promotion, or anywhere a third party is profiting from them) requires separate written permission.
Acceptable use
You agree not to use the site or portal to:
- Impersonate another person or wedding party.
- Scrape, copy, or republish portfolio content beyond personal sharing.
- Probe for security issues without our written permission.
- Send unsolicited bulk email, spam, or commercial offers through our inquiry form.
- Interfere with normal use of the site by others.
Visits to the site
We count visits to the public site so we can see which pages people read and keep the site secure. A visit record holds the page, the time, your device and browser, your approximate location, and your IP address. Where the law asks for your yes first, we ask. Everywhere, you can turn it off with the switch in our Privacy Policy, which lists every cookie involved. The signed-in portals carry no analytics.
Text messages
If you opt in to text messages, we may text you about your inquiry, booking, payments, and deliverables. Giving us your phone number alone does not opt you in. These messages are transactional; we do not send marketing texts. Message frequency varies with where you are in planning, typically 1 to 10 messages a month around your wedding date. Message and data rates may apply.
Reply STOP to any message to stop them, or HELP for help. Mobile information, including your phone number and your consent to receive text messages, will not be shared with third parties or affiliates for marketing or promotional purposes. The full details are in our SMS Policy.
Third-party services
We rely on a small group of vendors to run the site and service (Supabase, Stripe, MUX, Cloudflare, Resend, Twilio, Vercel, Google Analytics). Their handling of your information is described in our Privacy Policy. SMS specifics live in the SMS Policy.
Disclaimers
The site is provided “as is”. We don’t guarantee the site will always be available, error-free, or free of interruption, though we work hard to keep it running. Content on the public site (package details, portfolio entries) is for informational use; the final terms of any work are governed by your signed contract.
Limitation of liability
To the maximum extent allowed by law, Midsummer Productions isn’t liable for indirect, incidental, special, or consequential damages arising out of your use of the site or the portal. Our total liability under these site terms is capped at $100 USD or the amount you’ve paid us in the last twelve months, whichever is greater. Liability under a signed wedding contract is governed by the cap stated in that contract, not this one.
Ending access
You can stop using the site at any time. If you have a portal account and want it deleted, email us at hello@midsummerproductions.net.
We may suspend or end access for anyone who breaks these terms, or if we have to stop offering a service. We’ll give booked clients reasonable notice if a service change affects their wedding.
Governing law
These terms are governed by the laws of the State of Alabama, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in that state, and you agree to that venue.
Changes to these terms
We may update these terms from time to time. We’ll change the “Last updated” date at the top. Material changes will be announced via email to active clients before they take effect.
